The proposed measures would compel schools to allow transgender students to use bathrooms that align with their gender identity, bar gender identity-based harassment and ensure others are using their correct pronouns.
The department justified the decision by referring to a Supreme Court case that ruled it is impossible to discriminate against a person based on their sexual orientation or gender identity without discriminating against that person based on sex.
